Why Shouldn’t I Sign A Waiver Or Release And Settlement Agreement Without Contacting A Bed Bug Lawyer First?

Never, ever, ever sign any contract or agreement unless an experienced attorney reviews it. Over the last several months, our bed bug attorneys have received a higher volume of calls from customers of Aaron’s Furniture and Rent A Center claiming they purchased furniture from one of these stores and their home is now infested with bed bugs. A new trend we are seeing is that Aaron’s Furniture and Rent A Center are requiring customers to sign Waivers or Releases and Settlement Agreements before they remove the furniture from the customer’s home or pay for services of a professional exterminator. What ends up happening is the customer is so desperate to have the furniture removed and their home treated that they sign the waiver or release without contacting a lawyer first. This is a big mistake on behalf of the customer. Most of the time the waiver or release has similar language to the following:

In consideration of the mutual promises and agreements herein, including all the statements in this agreement, the Parties (Rent A Center and customer) agree as follows:

1. Rent A Center will provide customer treatment per ABC Exterminator and pay a settlement of $250.00 (two-hundred and fifty dollars) in full and final settlement of any and all claims customer has or may have against Rent A Center with regard to this incident.

The release or waiver of claims will include much more language then the above language limiting any sort of recovery for the customer besides the language contained in the agreement. If you were to sign a release with the above language the compensation you would receive for your injuries and damages is $250.00 and extermination services from ABC Exterminators. If you want to receive the maximum recovery for your injuries, property damage, lost wages, and out-of-pocket expenses do not sign a release or waiver of claims without first contacting a bed bug lawyer.
